Terms & Conditions (including Release and Indemnity)

When contacting us to change your details, please include the following information:

•    contact details (name, postal address, telephone number); and

•    your Burnet Institute supporter number (if you have one)

I agree to be bound by the following terms and conditions of the Romp event, including the release and indemnity ("Terms and  Conditions"), as a condition of entry of myself or my child, whichever applies, into the Melbourne City Romp (“the Romp Event”).

1. I agree that I or my child, whichever applies, will abide by all of the rules of the Romp Event as a condition of entry.  Full rules can be viewed on the Romp website www.cityromp.com under the “Rules” tab (“the Rules”).

2. I agree that together with the Rules, these Terms and Conditions govern attendance at and participation in the Romp Event of myself or my child, whichever applies; the use by myself or my child, whichever applies, of www.cityromp.com (the event website); and the purchase by myself or my child, whichever applies, of any goods from it. I agree that the website is owned and operated by Burnet Institute.

3. I agree that for Burnet Institute to process the entry application of myself or my child, whichever applies, into the Romp Event it needs entrant information, such as entrant’s full name, email address, mobile phone number, address and other personal details.

4. I agree that if I do not receive an email confirmation of entry of myself or my child, whichever applies, such entry has not been processed. I agree that if I do not receive an email confirmation I will contact the Romp team by phoning 03 8506 2350 or by emailing askus@cityromp.com.

5. I agree that the entry of myself or my child, whichever applies, will not be confirmed until payment in full has been received by Burnet Institute and it is satisfied with the integrity of the entry information.

6. I agree that Burnet Institute will not refund payment for entry of myself or my child, whichever applies, under any circumstances.

7. I agree that prices of goods, delivery and other charges displayed on the Romp website are current at the time of display, and that these prices are subject to variation without notice.

8. I agree that Burnet Institute will always use its best endeavours to be as accurate as possible with its descriptions, images and pricing.

9. I agree that all prices quoted are inclusive of GST and all prices are quoted in Australian dollars.

10. I agree that merchandise products are subject to availability and that if an item sought to be purchased is out of stock, Burnet Institute will notify me or my child, whichever applies, immediately to confirm a scheduled delivery date.

11. I agree that Burnet Institute does not warrant that a product is available or suitable for the purposes of myself or my child, whichever applies, and I agree that Burnet Institute will not be liable for any product that is not available or not suitable for the purposes or individual needs of me or my child, whichever applies.

12. I agree that if merchandise products are purchased from Burnet Institute, I or my child, whichever applies, may be required to provide such personal details as the name, email address, mobile phone number, address and other personal details of myself or my child, whichever applies.

13. I agree that Burnet Institute may subsequently require further details to enable the processing of any purchase and/or entry of myself or my child, whichever applies, and that if required by Burnet Institute, I will provide it with relevant current, complete and accurate personal information when asked to do so by or on behalf of Burnet Institute.

14. I agree that it is a violation of the law to place merchandise orders under a false name or with a fraudulently obtained credit card, and that fraudulent ordering will be prosecuted to the fullest extent the law allows.

15. I agree that any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution and that Burnet Institute does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website.

16. I agree that during all times while I or my child, whichever applies, is attending and participating in the Romp Event, I or my child, whichever applies, do or does so at my or his or her own risk.  I agree that if I or my child, whichever applies, find myself or finds himself or herself in physical or emotional difficulty during attendance at and/or participation in the Romp Event, then I or my child, whichever applies, will immediately cease attending at and/or participating in the Romp Event, and seek help and/or assistance and advice.

17. I agree that the recreational activities engaged in during the Romp Event are activities that will be undertaken for the purposes of recreation, education, enjoyment and/or leisure and involve a degree of physical risk.  I agree that such recreational activities will be engaged in for the benefit of myself or my child, whichever applies, and/or the benefit of any person attending and/or participating in the Romp Event under my care and control, and that at all times during the Romp Event I am responsible for the actions of myself or my child, whichever applies, and/or for the actions of any other person under my care and control attending at and/or participating in the Romp Event.

18. I release Burnet Institute, its directors, employees and agents from any liability,  loss or damage of any nature whatsoever or howsoever caused relating to any personal injury to myself or to my child, whichever applies, during attendance at and/or participation in the Romp Event, and/or from any liability, loss or damage of any nature whatsoever or howsoever caused relating to the death of myself or my child, whichever applies, during attendance at and/or participation in the Romp Event, and/or from any liability, loss or damage of any nature whatsoever or howsoever caused relating to any personal injury to or the death of any other person under my care and control during attendance at or participation in the Romp Event.

19. I agree to indemnify the Burnet Institute, its directors, employees and agents for any liability, loss or costs it or they may incur from any demand made or action taken or commenced by any person against the Burnet Institute, its directors, employees and/or agents arising out of the attendance at and/or participation in the Romp Event of myself or my child, whichever applies, and/or arising out of the attendance at and/or participation in the Romp Event of any other person under my care and control.

20. I agree that the Burnet Institute and the Photographer who retains ownership of the image, has the right to use in accordance with applicable laws any photograph, video footage or other visual image taken of me or my child, whichever applies, participating in the Romp Event in any Romp Event promotional material, and has the right to identify me or my child, whichever applies, by name with any such image.

21. I agree to receive communications from the Burnet Institute for the purposes of promoting the Burnet Institute and the Romp event. The Burnet Institute will respect my information and will adhere to the Romp Privacy Policy.

22. The Virtual Romp - there are eight weekly prizes in our weekly Virtual Romp Competition. Each prize consists of a $200 voucher from Michaels Cameras, Video, Digital and is valid for photography courses, equipment hire and photo processing at Michaels. Prizes must be redeemed by 20/03/11.

23. The Contiki Holidays Prize

a) Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

b) Entry is only open to Australian residents aged between 18-35 years inclusive. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

c) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

d) The first valid entry drawn will win the Major Prize. The Major Prize consists of a 10 day Contiki Vietnam Highlights tour for two (2) people, valued at up to AUD$2,290.00. The Major Prize also includes return economy airfares from Melbourne to Ho Chi Minh City, Vietnam valued at up to AUD$1,710.00. Airline chosen is at the discretion of Contiki Holidays and subject to the airline rules and regulations. The most direct flights will be booked and no changes to routing are permitted. Major Prize is subject to the standard terms and conditions of individual prize and service providers.

e) Your final travel date must be confirmed to Contiki on or before 1 August 2010 otherwise your prize will no longer be valid and will be forfeited. Extension cannot be issued. All travel must be redeemed and completed by 28 September 2010.  

f) The prize is valid for Contiki’s Vietnam Highlights tour on departures between 21 March 2010 and 19 September 2010 from Contiki’s Asia 2010/11 brochure. Accommodation is on a twin-share basis.

g) The prize is subject to availability, non-transferable and not redeemable for cash.

h) Taxes, passports, visas, some meals, spending money, transport to and from departure and arrival points and all other ancillary costs are not included and are the winner's responsibility unless otherwise stated.

i) Government and Airport taxes are not included and are payable prior to tickets being issued.

j) Reservations are available on a firm space basis subject to availability at the time of booking (please note availability is limited during school holidays and peak holiday periods).

k) The air tickets are non-transferable, non-changeable, not redeemable for cash and travel is restricted to the airline’s (chosen at Contiki’s discretion) operated aircraft and direct services only.

l) Frequent Flyer points are not applicable.

m) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any theft, unauthorised access or third party interference; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions; (d) if the Contiki tour is cancelled for any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

n) In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

o) As a condition of accepting the Major Prize, the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  

p) Total prize pool value is up to AUD$4,000.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

q) All entries become and remain the property of the Promoter. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter.
